Welcome to Porche Photography. By booking a session, purchasing a collection, or using this website, you agree to the following terms and conditions. These terms ensure that we can provide you with the highest level of service while "capturing precious moments in time."
1. Professional Services & Creative Integrity
Porche Photography (the "Studio") provides professional photography services including, but not limited to, portraits, headshots, boudoir, and maternity. With over 25 years of experience, the Studio retains absolute creative control over the editing process and artistic style. Only the final, edited images included in your chosen collection will be delivered; raw files are not available for release.
2. Booking, Payments, and Retainers
Retainer: A non-refundable retainer is required to secure your session date. This amount is applied toward your total collection price.
Payment: All collections and services must be paid in full prior to the delivery of the final image gallery or physical products.
Pricing: Porche Photography reserves the right to adjust pricing. However, once a session is booked and the retainer is paid, your price for that specific service is locked in.
3. Rescheduling & Cancellations
We understand that life happens. Clients may reschedule their session once with at least 48 hours' notice without forfeiting their retainer. Cancellations or "no-shows" with less than 48 hours' notice will result in the forfeiture of the retainer.
4. Studio & Location Policy
Sessions are held at our Katy, TX home studio, a rented professional studio space, or an agreed-upon outdoor location. Clients are responsible for any permit fees or entrance fees required by specific locations outside of the Studio’s home base.
5. Usage & Copyright
Ownership: According to U.S. Copyright Law, Porche Photography retains the copyright to all images created.
Personal Use License: Upon final payment, clients are granted a non-exclusive, perpetual license for personal use (printing, social media sharing, and personal archiving).
Prohibitions: Clients may not sell, edit/alter (no filters), or enter images into contests without express written permission from the Studio.
Model Release: The Studio may use images for promotional purposes (website, social media, portfolio) to showcase our 25-year history. If you require a privacy waiver (common for Boudoir), please notify us in writing prior to the session.
6. Archiving & Digital Delivery
Galleries are delivered via our digital CRM or a dedicated gallery link. While we strive to maintain archives of your "precious moments," the Studio is only responsible for hosting your digital gallery for 30 days following the delivery date. It is the client’s responsibility to download and back up their images immediately.
7. Limitation of Liability
The Studio takes the utmost care in equipment maintenance and data redundancy. However, in the unlikely event of equipment failure, data loss, or illness that prevents us from fulfilling the contract, the Studio’s liability is limited to a full refund of all monies paid by the client.
8. Governing Law
These terms are governed by the laws of the State of Texas. Any disputes shall be handled within the jurisdiction of Fort Bend, Whaller or Harris County.
